Understanding the Constitution: The Power to Restrict Immigration

The Constitution doesn’t use the word “immigration.” Those consulting the constitutional debates of 1787–1790 (such as the essays in “The Federalist”) will find no discussion of the subject.

Consequently, some modern writers argue that, constitutionally, America should be an “open borders” country—that Congress has no power to limit immigration. Others say that there must be immigration-control authority somewhere in the Constitution. After all, the document alludes to a power in Congress, beginning in 1808, to prohibit the “Migration or Importation of … Persons” (Article I, Section 9, Clause 1). The word “Importation” refers to the slave trade, but “Migration” refers to the movement of free people.

This uncertainty has encouraged the usual claims that the Constitution is defective and that the framers made another of their alleged mistakes.

False Answers

In a recent Epoch Times essay, I described the “Great Forgetting,” during which 19th-century Americans lost the meaning of key terms in their own Constitution. One of the casualties of the Great Forgetting was the source of Congress’s immigration authority. The amnesia continues even today: I recently used the Westlaw database to collect articles on immigration composed by law professors. The overwhelming majority still had no clue as to the source of Congress’s immigration authority.

Even the Supreme Court has cast about for an answer. In 1875, the court concluded that Congress’s authority to restrict immigration stemmed from its power to “regulate Commerce with foreign Nations” (Article I, Section 8, Clause 3). The justices soon abandoned that idea—and with good reason: Non-commercial cross-border travel is not “Commerce” as the Constitution uses the word (pdf).

In 1889, the court suggested that the power to control immigration was “inherent” in the federal government’s sovereignty (pdf). Some modern writers agree. But that proposition directly violates the terms of the 10th Amendment, which prescribes that if a power isn’t listed in the Constitution (or incidental to a listed power), then the federal government doesn’t have it.

Still, other writers speculate that Congress’s authority to regulate immigration comes from its power “To establish an uniform Rule of Naturalization” (Article I, Section 8, Clause 4). But that dog won’t hunt, either. Immigration control is a subject as important as, and separate from, naturalization: It isn’t merely incidental to naturalization (pdf).

Modern writers have offered other suggestions as well, but they are even more far-fetched.

The ‘Define and Punish’ Clause

As I mentioned briefly in an earlier Epoch Times essay, Congress’s authority to limit immigration is contained in its power to “define and punish Piracies and Felonies committed on the High Seas, and Offenses against the Law of Nations” (Article I, Section 8, Clause 10). This is called the Define and Punish Clause. The phrase “the law of nations” is the 18th-century term for international law.

When the Constitution was written (as today), there was no international agency available to punish certain conduct internationally recognized as criminal. Moreover, international law usually didn’t specify the elements of such a crime, how a defendant should be charged and tried, or what the punishment might be. Without such standards, it was impossible to apprehend and punish those who violated international law while still respecting the rules of due process. It was a common practice on capturing a pirate, for example, to string him up then and there.

The Define and Punish Clause addressed this situation by granting Congress authority to enact criminal statutes setting forth the details of piracy and other “Offences against the Law of Nations.” 

The ‘Law of Nations’

In the 18th century, the term “nation” often referred to an ethnic group—such as “the Arabs” or “the Koreans”—rather than to a sovereign state. A sovereign state might be composed of one “nation” or of many. Or a “nation” might (as is true of the Arabs and Koreans today) sprawl across several sovereign states.

Two thousand years ago, the Romans developed a common law for non-Romans within their empire. They called it the ius gentium—“the law of ethnic groups” (or “peoples”). Later, the spelling was altered to jus gentium.

In accordance with the contemporaneous meaning of “nation” as an ethnic group, the phrase was translated into English as “the law of nations.” A more modern translation might be “the jurisprudence of all ethnic groups.”

Despite the ancient origins of the jus gentium, the modern law of nations didn’t take shape until the 17th century. The man generally recognized as its founder was the brilliant Dutch scholar and diplomat Huig de Groot. His masterpiece, published in 1625, was entitled “De Jure Belli ac Pacis” (“The Law of War and Peace”). It was, like all learned books of the time, composed in Latin, and the author’s name was Latinized to “Hugo Grotius.” It is by his Latin name that he is known today. (This is true of many historical figures: We also refer to Cristoforo Colombo by his Latin name: “Christopher Columbus.”)

As formulated by Grotius, the law of nations applied not just to “nations” in the sense of ethnic groups, but to sovereignties. It sometimes applied to individuals as well.

Following in the footsteps of Grotius were other outstanding international law scholars. The most important were Samuel von Pufendorf’, a German who published his leading work in 1672; Christian Wolff, another German, who published in 1749; and Emer de Vattel, a Swiss lawyer and diplomat, whose 1758 volume was composed in French. Additionally, a French scholar, Jean Barbeyrac (1674–1744), gained fame for his translations of, and commentaries on, the works of Grotius and Pufendorf.

America’s Founders were familiar with all of these scholars. American courts relied on the opinions of Grotius, Pufendorf, Barbeyac, Vattel, and, more rarely, Wolff. In 1783, a committee of the Confederation Congress recommended a list of important books for acquisition. They included the principal works of all these authors. The committee was a notable one. It consisted of three men destined to be among the Constitution’s framers: James Madison, Thomas Mifflin, and Hugh Williamson.

During the Constitutional Convention, delegates cited Vattel. During the subsequent public debates over the Constitution’s ratification, participants mentioned Grotius, Pufendorf, Barbeyrac, and Vattel.

An author even more famous among Americans also devoted some attention to the law of nations. He was William Blackstone, whose “Commentaries on the Laws of England” was the most popular law book in the United States.

Immigration Control as Part of the Law of Nations

We can summarize the rest of the story quickly. Here it is:

  • All of these authors affirmed that just as one usually may not enter a property-owner’s land without permission, it usually is an “Offense against the Law of Nations” to cross another sovereign’s borders without permission.
  • If a state intrudes into the territory of another state without the consent of its sovereign, the intruding state offends against the law of nations. If an individual enters the territory of a foreign state without the consent of its sovereign, the individual offends against the law of nations. It also violates the law of nations for a state to permit or encourage its citizens to cross a foreign border without permission.
  • There are some exceptions and modifications to the foregoing rules. The authors disagree slightly on their scope. However, they agree that a sovereign has a legal or moral obligation to try to accommodate exiles, refugees, those shipwrecked on foreign shores, and those required to pass through a foreign country. Even in those cases, however, each sovereign has wide discretion to set the terms and conditions of entry.
  • All of this was confirmed by yet another international law scholar, Georg Friedrich von Martens, a German professor who published in 1789, while the Constitution still was under debate in North Carolina, Rhode Island, and Vermont.

Thus, Congress’s power to “define and punish Offenses against the Law of Nations” includes authority to adopt laws restricting immigration. As chief executive, it’s the president’s sworn duty to “take Care that the Laws be faithfully executed”—and therefore to enforce those laws.

Once again, a claimed weakness in the Constitution turns out to be non-existent, and the framers are absolved of error. The prevailing uncertainty on this subject is our fault, not theirs.

Physicians are Suing the FDA for Misleading the Public About Ivermectin

Ivermectin is a Nobel Prize-winning medicine that was affordable, licensed, safe, and approved for off-label use until doctors tried to use it to treat flu patients with COVID19. The FDA not only got between you and your doctor, but they also convinced boards of health to threaten the licenses of physicians and pharmacists.

The result was a chilling effect on the doctor-patient relationship that likely resulted in a significant increase in severe disease, hospitalization, and death.

An actual crime against humanity.

The Association of American Physicians and Surgeons (AAPS) issued an amicus brief in support of Apter v. HHS,  the FDA, for meddling to the detriment of their patients.

 

“Defendant FDA has improperly exploited misunderstandings about the legality and prevalence of off-label uses of medication, in order to mislead courts, state medical boards, and the public into thinking there is anything improper about off-label prescribing,” AAPS writes in its amicus brief to the court. “Not only is off-label prescribing fully proper, legal, and commonplace, but it is also absolutely necessary in order to give effective care to patients.”

 

Until COVID, I’ve been led to understand that doctors were at liberty to write scripts for off-label use of licensed drugs for whatever purpose they and their patients deemed appropriate. It was a doctor-patient thing. Treat each person based on the symptoms and their circumstances. But the Wuhan flu sent the Public Health Industrial Complex (PHIC) into Hitler mode.

Politicians piled on blindly following Federal agency guidelines even when they contradicted all known practices, including those agencies’ previous research. The result was more illness, hospitalization, and death, complete with cash incentives for the PHIC if it ignored patient health and safety and did as they were told.

Hospitals and state’s cashed in, scooping up trillions in taxpayers’ dollars while those taxpayers were losing jobs and businesses and getting an illness for which they could not get proper treatment.

Let’s just say someone said, enough of this crap, and they sued the FDA.

 

AAPS General Counsel Andrew Schlafly pointed out to the court that the FDA “has engaged in a campaign of interference with the proper use by physicians of ivermectin, which has long been approved as fully safe for human use.” He alerted the court that once the FDA approves a medication as safe, then physicians have full authority to prescribe it to treat any illness, particularly a novel virus like Covid-19.

 

If the FDA gets away with it, they’ll do it again, putting the interests of politics and big pharma ahead of doctors and their patients the machinery of public health, and will continue to pursue self-interest before all else. And that, we cannot have.

Biden Bangs the War Drums on Indians

Joe Biden is the President that was to unify all Americans. It did not matter the color of your skin or the balance of your 401k, Joe wanted to be the man in your corner. Well, Joe is a flat-out fraud.

Joe has proven that he is the biggest divider ever to sit behind the resolute desk, and he has no prejudice when it comes to screwing Americans. Today, he threw his tomahawk squarely at the Red Americans. Today, he canceled all oil drilling leases on Indian reservations. The Red Man is unhappy with Joe today, and you don’t need to read the smoke signals to feel their anger.

The Indians relied on the income from these oil drilling rigs, and they are beyond angry. He has made a decision regarding the ability to make money on private land. In this case, he has violated the sovereignty of Indian land. Joe Biden may have gone too far with his war on fossil fuels. But at least he is making his Vice President happy by treating his war on fossil fuels with equity. He has effectively taken down every sector of American Society.

The cost of gas has been declining, which was something this warped administration was bragging about. They had driven the price of a gallon of gas to over $5, and they bragged about it coming down to $3.50. Great Job, Joe. It was $2.25 when you took your oath. You cannot remember either of these markers. It was and is your bad policies that are costing every American thousands a year in increased cost of gas and home heating fuel. Your anti-fossil fuel policies are the most significant broad-based tax increase ever.

It is evident that the American public does not share the administration’s zeal for Green policies and the war on fossil fuels. The American public is not excited about trading in their gas-burning automobiles for a toxic battery-powered electric vehicle. You will have to pull the keys of my four-wheel drive Jeep from my dying hands before you put me behind the wheel of a Chevy Volt.

Parshall, North Dakota includes 464 nearby oil and gas leases. Parshall (Hidatsa: dibiarugareesh) is a city lying within the jurisdictional boundaries of the Mandan Hidatsa and Arikara Nation. It is located on the Fort Berthold Indian Reservation in Mountrail Count,y North Dakota. These Native Americans have lost a major revenue stream thanks to Joe Biden. Does Joe consider the collateral damage of any of the bad decisions he makes, or is that beyond his purview? This is only one situation. Joe Biden’s decision will impact nearly every reservation in the country.

Apparently, Joe does not see this as pushing American and Alaskan Indians away from the Democrat Party. Like Blacks and Browns, Indians have traditionally voted Democrat. This trend is changing significantly with Blacks and Browns, and bad decisions like this Fossil Fuel killing act by Biden may add the Reds to that changing demographic.

We are in a dynamic time domestically and internationally and Joe Biden and Kamala Harris are filling the news cycle with their blunders when we need to see their best efforts at showing American strength and resolve. In the old days, when the Mafia families went to battle, they needed wartime leaders and consiglioreris. America is at war with illegal immigration, fentanyl poisoning, inflation, and an energy crisis. There is no wartime leader anywhere near 1600 Pennsylvania Avenue, and will not be for two years. Can we hold on for two more years of Biden’s Progressive insanity? Only time will tell.

Wife of Biden Chief of Staff Gets Make-Work Job as “Ambassador” to Plants, Water, and Animals

While the Democrat spending spree continues to devastate Americans and demolish the economy, Whoever is Running the Biden Administration (Ron Klain?) just gave their wife a made-up job with full pay and benefits.

 

“For the first time, the United States is designating a special diplomat to advocate for global biodiversity amid what policymakers here and overseas increasingly recognize as an extinction crisis,” the Washington Post reported on Thursday, under the headline “In a first, U.S. appoints a diplomat for plants and animals.”

“Secretary Antony Blinken has designated Monica P. Medina as the United States’ Special Envoy for Biodiversity and Water Resources, signaling the Biden-Harris Administration’s commitment to resolving the world’s intertwined biodiversity and water crises,” the State Department announced Wednesday. “Monica Medina is the Assistant Secretary of State for Oceans and International Environmental and Scientific Affairs and will take on the Special Envoy designation in addition to her current duties.”

 

Medina is an environmental activist lawyer (Georgetown and Columbia) who founded an Environmental Newsletter. She has experience in the swamp, and her hubby happens to be the guy who is probably running the country (into the ground). No, not Joe Biden, White House Chief of Staff Ron Klain.

Klain runs things, including deciding who gets cushy jobs like Special Envoy to the Earth Birthing Person. It is a position that will require a workspace, office staff, supplies, underlings, and a large budget, all of which will add to the government’s already significant carbon footprint, deforestation, and emissions. It will also increase the regulatory burden, which, by extension, will exacerbate that carbon footprint exponentially across the increasingly fruitless plains.

As usual, this is the opposite of the advertised outcome.

Do you know what would reduce emissions if you are into that? Downsizing the federal government. It is probably one of the biggest polluters on the planet. But that’s not what Democrats are after. Their number one goal is to grow government, even if it means creating a make-work job for the White House Chief of Staff’s wife.

Well, This Will Be Interesting to Watch: NH Speaker of the House Race

AFTER THE VOTES are counted Nov. 8, there will be another election at the State House. The race for speaker of the New Hampshire House of Representatives is heating up.

…Many observers figured House Speaker and 18-term state Rep. Sherman Packard, R-Londonderry, would have a clear path to the nomination by the Republican caucus to keep hold of the gavel. This would be Packard’s first full term after replacing House Speaker Dick Hinch, who died from complications with COVID-19 soon after taking over in December 2020. Not so fast.

According to multiple sources in both parties, four-term Rep. Leonard Turcotte, R-Barrington, told associates he is exploring a GOP challenge to Packard…Legislative process disputes are one motivation behind Turcotte’s potential candidacy. Packard removed Turcotte from two conference committees because of his strongly held views, including a desire to do away with Gov. Chris Sununu’s voluntary paid family leave program.

This isn’t an ideological debate — Turcotte and Packard are both solid fiscal and social conservatives.

…If the race happens, install Packard as a clear favorite. It’s very difficult to unseat a sitting speaker.

To be competitive, Turcotte would have to hope this election delivers dozens of newly elected House members who aren’t beholden to the status quo.
Some close to the speaker hope a cease-fire will emerge, with Turcotte brought more into the leadership fold as an olive branch.

All of the above assumes that the Republicans keep the majority, naturally.

Hmmm…we’ll be watching.

NH Schools Developing Psychological Profiles on Your Children (SAU16, SAU21 and others)

School administrators are going ahead with SEL (Social and Emotional Learning) surveys on your children. This allows Ed Tech vendors to collect sensitive mental health data on students, in order to build a psychological profile on them.

SAU21 and SAU16 are both using the PEAR survey that coincides with developing the Portrait of a Graduate/Learner, which you can read about here and here. All of this is tied to collecting massive amounts of sensitive data on your children. However, many other districts around New Hampshire are engaging in the same practices. It would be wise for parents to start looking at what SEL (Social and Emotional Learning) programs are being implemented in the school.

If you haven’t noticed what’s going on in your child’s class, you might want to look at their assignments. Many of them are focused on self-examination of your child VERSUS learning the academic content that should be taught in the classroom. This is a path to illiteracy in those core subjects because it shifts the focus away from academics.

That is why I asked SAU16 for a copy of the questions they will be asking students. The good news is they did ask for parental consent, which is required by federal and state law. However, it looks like SAU16 failed to post the survey questions on their district website. Posting questions on the district website when they administer non-academic surveys, is required by New Hampshire law.

Here is what was sent to SAU16 parents;

Dear Parent/Guardian,

We continue to be very excited to collaborate with Partnerships in Education and Resilience (PEAR) in order to promote the positive social-emotional development of our school community and students. We continue to be dedicated to the developing evidence that helping students feel good about themselves, their school and their relationships improves their learning.

Thank you to all who have opted-in for our PEAR survey.  We are on our way to getting a strong response from our parents and we are hoping that more of you will be willing to agree to opt-in for this survey in the next week so we can reach a significant survey number that will help us better support your child.  We are extending the survey date to October 6th, 2022 to allow all parents who wish to have their child participate in this dynamic survey.  Every student who opts-in to the survey will support CMS helping students increase their academic and social development! With extending the survey date, we are also extending the OPT-IN Response Date to October 3rd, 2022.

As a reminder the statements that are on the survey are based on agreement terms. Here are two examples.

  • I enjoy playing board games with friends (I strongly agree, I agree, I have no opinion, I disagree, I strongly disagree)
  • I enjoy lunch with my friends (I strongly agree, I agree, I have no opinion, I disagree, I strongly disagree)

All statements on the survey are available upon request.  All stored data has students’ names replaced by an ID number that is only accessible to designated team members.  This information can help staff tailor teaching and support to your child’s unique strengths and challenges.

Once the survey is complete and data is gathered, CMS and PEAR will continue its collaborative efforts to develop tier 1 and 2 social-emotional learning lessons to strengthen the overall life of a student at CMS. PEAR will use data from our school for research and educational work. Your child’s name is not accessible so will never be used as part of any research project.

I followed up with an email asking to see the questions on the mental health survey:

Once I read the questions, I then sent this email back to Mr. Perez and the school board members in SAU16:

Mr. Perez: Thank you for your prompt reply. You did not answer my question about why this survey has not been posted on the district website.  Please tell me why the PEAR survey has not been posted on the district website as required by state law.  No one should have to email staff members to access a non-academic survey. This information should be posted on the website as required by law: According to RSA 186:11, IX-d requires you to: 

IX-d. Require school districts to adopt a policy governing the administration of non- academic surveys or questionnaires to students. The policy shall require school districts to notify a parent or legal guardian of a non-academic survey or questionnaire and its purpose. The policy shall provide that no student shall be required to volunteer for or submit to a non-academic survey or questionnaire, as defined in this paragraph, without written consent of a parent or legal guardian unless the student is an adult or an emancipated minor. The policy shall include an exception from the consent requirement for the youth risk behavior survey developed by the Centers for Disease Control and Prevention. The policy shall also allow a parent or legal guardian to opt-out of the youth risk behavior survey developed by the Centers for Disease Control and Prevention. The school district shall make such surveys or questionnaires available, at the school and on the school or school district’s website, for review by a student’s parent or legal guardian at least 10 days prior to distribution to students. In this paragraph, “non-academic survey or questionnaire” means surveys, questionnaires, or other documents designed to elicit information about a student’s social behavior, family life, religion, politics, sexual orientation, sexual activity, drug use, or any other information not related to a student’s academics.

In addition, mental health assessments and treatment require parental consent per Federal Law. It is my understanding that the district did require parental consent for this screening. It would be helpful if they were also provided information on how this vendor will protect the privacy of the students. We can already see that they collect PII on the students’ mental health. I have found that these vendors have loopholes in their privacy policies. In other words, they’re not private at all.  Question #22 in the last section asks: I take things that are not mine from home, school, or elsewhere.    While the survey does include a statement on stopping the survey at any time, will anyone explain to children that this question requires a student to self-incriminate? I do not see any instruction that would explain to the student, their fifth amendment rights under the United States Constitution. While this normally applies to a criminal justice system, normally children come to school to learn academic content, not answer questions on whether they’ve participated in an illegal activity.    Within the privacy policy it says: . Notwithstanding any exceptions in the definition of Confidential Information, the parties agree to treat all Education Records as Confidential Information and disclosure thereof is allowed only to the extent permitted under FERPA.     FERPA now includes a loophole that you can read about here: Big Tech Makes Big Data Out of Your Child: The FERPA Loophole EdTech Exploits to Monetize Student Data  Excerpt: The legislation’s overly broad definition of education records, combined with the 2011 Amendments expanding FERPA to permit schools to disclose data to third parties, creates a loophole for the EdTech industry to avoid COPPA regulation regarding student data.10 As a result, commercial companies can quickly amass large amounts of data and potentially avoid the FTC’s oversight of COPPA compliance by contracting directly with schools.11 This practice runs afoul of legislative intent for both FERPA and COPPA, places student data at risk by creating a vacuum of oversight, and leaves little recourse for violations of data collection or use in the EdTech industry.12
  To the school board members, especially if you have children in the public school, you might want to brush up on the massive data mining that is taking place in SAU16 and public schools across the country. You are bringing in a vendor to collect mental health data on your children, and I have not seen any attempt to explain to parents what all of this entails. What happens if this company is sold? Who then will have access to your child’s sensitive mental health data? Who stores all of the data? Will the data ever be destroyed? What happens if there is a breach? How will you contact parents ?    Did you know that all you have to do is call yourself a researcher and you can access PII? The safeguards that were once in place to prevent your child’s sensitive data, no longer exist. FERPA was gutted so that technology companies can have free reign to your child’s most personal and sensitive information.  They will build a psychological profile with this information on your children, and it’s why many parents are quietly removing their children from the public schools.    It is your responsibility to look out for your children and the families you represent in the district. How much research have you done on this ?

Notice how the email to parents suggests that they should be excited about this? Notice how they gave two sample questions but left out the self-incriminating question? Notice how they didn’t attach the survey to the notice but instead required parents to contact them for a copy?  This is like being excited about buying a used car from the slick salesman who never tells you the engine doesn’t work. Do you hire these people to sell you garbage or inform you with details, facts, and information? It appears as if SAU16 is run by some of the slickest snake oil salesmen out there.

The American Red Cross Is Not Labeling mRNA “Vaccine” Tainted Blood Donations

If you find you need blood, we have some bad news. The American Red Cross is either not asking donors if they’ve received the mRNA Covid “vaccines” or not labeling blood from these donors if they are asking for vaccine status.

 

“We don’t label blood products as containing vaccinated or unvaccinated blood as the Covid-19 vaccine does not enter the bloodstream and poses no safety risks to the recipient,” the Red Cross claims.

“If you have safety concerns about potential blood transfusions, please speak with your medical care team.”

 

Even if you are Jabbed, this might be a matter of concern.

 

We have found crystalline formations in the blood of all the vaccinated people whose blood we examined. We are continuing to analyse these formations. In every case that we have examined, we have observed a rouleaux formation of the erythrocytes (the red blood cells) and we frequently observe an unusually rapid disintegration of the different types of cells in the vaccinated blood that we examine.

 

Using AI technology to screen samples, these European researchers were also able to identify who received the COVID “vaccines” and who had not by looking at their blood. The claim these injections change your blood and not just in the short term. Blood is being distributed around the country and perhaps the world without any indication that it came from an mRNA “vaccinated” individual.

It sounds like the evil plot from some comic-book supervillain. First, we release an engineered flu virus into the world. Then we ignore safe, licensed drugs and OTC therapies in favor of a vaccine that (as it turns out) doesn’t help and might make matters worse. We insist everyone get it or else. And then we allow the “vaccinated” to donate blood that will filter into the general population until nearly everyone has this junk in them.

The blood and junk are connected to a wide range of side effects and complex long-term health problems.

I know it sounds crazy, but we’re living it and do not know if tainted blood is limited to the American Red Cross or if organizations that handle blood products are as disinterested globally.

Think about the potential harm to the ill or injured. Anyone with pre-existing heart or clotting issues would be at high risk for starters.

And the response from the Public Health Industrial Complex, at least in the form of the American Red Cross, is whatever. It’s not a concern. They have no intention of segregating blood from mRNA-vaccinated donors.

So, be careful out there, people.

I get that people look at this statement, and other similar ones from Pelosi, both Clintons, Schumer, and others… and scream HYPOCRITE!  No.  NoNo.  You don’t get it.  This is not hypocrisy.  This is distraction.  This is deception.  They know… they’ve known since 1965 (and doubtless earlier) that population replacement is the goal.  Or, at least, population dilution of the mostly-white, mostly-conservative population to the point where they have an electoral majority.  A permanent electoral majority.

They’ve said these things for decades and fooled most into believing they really believed this was a crisis they were actually addressing.  Instead, it was a maskirovka to distract and deflect from the fact that they did nothing meaningful… thus letting more and more into the country.  (I remember a picture of a news conference where a “bipartisan” Senator group was discussing yet another round of amnesty, and here was McCain holding forth while Chuck-E-Cheese Schumer was grinning from ear to ear.  He knew.  Same thing with Billy-boy Clinton now coming out about the southern border.  I have no doubts he doesn’t care… but now they think they have enough across the border that they can start paying public attention.  What is it, two million?  Three million before anything’s actually done?  Four?  That’s more than enough to demographically swamp this nation where most elections are only won by a few percentage points.)

For-Profit Passenger Rail Fail: Boston Surface Railroad Declared Bankruptcy, Ousted from Headquarters

In 2017, Nashua eagerly embraced an opportunity to build a rail stop for the newly formed Boston Surface Railroad. It was a planned for-profit passenger rail service with a dirty public money secret we exposed back in 2017.

I aired my discovery on The Girard at Large Radio Show in September 2017. The for-profit business and Nashua were all looking to tap into federal grants to make things happen. Your money for their commuter rail fantasy never came together even though Nashua kept piling funds into reports to make it look like it would be suitable for Nashua and the Granite State.

Neither is true, nor has it been, despite the continued effort to push for commuter rail up through the Manchester Concord Corridor. And Boston Surface Railroad is proof of a failed concept. They couldn’t even get their limited passenger rail idea off the ground.

 

On June 28, 2019, the Boston Surface Railroad Company was involuntarily dissolved for failure to file an annual report by the Secretary of the Commonwealth of Massachusetts, though it was reinstated two months later after the delinquent reports were filed.[10]

On October 6, 2019, the company filed a Chapter 11 Bankruptcy petition in the U.S. Bankruptcy Court for the District of New Hampshire.[11] At the time, the Rhode Island Department of Transportation had won an eviction case against the company that would have ousted it from its headquarters at the Woonsocket Depot.[12]

 

But wait, there’s more! They’ve not given up. The next barrier to success was…the pandemic. Yes, I can see that. Trying to operate in any New England State was difficult, especially if you didn’t have a business, especially in New Hampshire, after your filing was rejected.

Rumor has it they plan to try their hand at bus service in 2022, but that’s also from Wikipedia, and I can’t confirm that. Nothing on their website except an email list building form and an alert that service is suspended due to the pandemic.

The pandemic is over, didn’t you hear? It means the website updates are suspended as well. Always a good sign.

But Dems just passed that inflation reduction bill that was little more than a green energy boondoggle bailout. Rail is integral to that planned failure, so maybe Boston Surface Railroad can grab a piece of that?

I know Nashua will be fishing for cash to write another 30-page report extolling the value of commuter rail even though a private company couldn’t make it work after nearly ten years of failing.

Kari Lake is being hidden from the public’s eye, and for a good reason. Corporate media and the establishment hacks in Washington, D.C. are terrified of what a tough-as-nails conservative governor could do in another crucial swing state, just as DeSantis turned Florida from purple to deep red.

And she’s female to boot – not that conservatives care, but her presence electrifies the woke conversation. It’s hard to be misogynistic when you’re cheerleading for Arizona or voting for a female vice president.

Lake has truly been unstoppable. She has gone after Big Pharma, Big Government, and Big Media and even tackled subjects most avoid altogether, such as the Epstein cover-up and the 2020 election narrative. She is smart, bold, and willing to speak honestly to the American public.

For that, the powers that be hate her.

Since her loser, cowardly Democrat opponent refuses to debate her, Lake has had much more time to hit the campaign trail and hold media events. At each stop, some wacko leftist journalist tries cornering her and she immediately pounces. Watch this latest nuke from Lake after a stammering journalist tried asking her about Liz Cheney.

The reporter meekly prompted that “Liz Cheney said that she’s gonna do whatever is in her powers…to stop you from becoming governor” and Lake immediately took the bull by the horns.

 

Well, Liz Cheney doesn’t know me, and she couldn’t even win her own primary. The people of Wyoming – [interrupted by laughter]  – the people of Wyoming have turned on her, they’re like ‘get out’, and now she’s looking for a place to go and apparently she wants to come to Arizona and campaign against me.

It’s the best gift ever in politics When Liz Cheney says she doesn’t want you elected, then  you know the people want you elected.

he new Republican Party is the party of we the people. It is the party that will represent the working class. It’s the most inclusive party in all of politics. And we’re going to start working for the people.

And we’re turning our back on politics as usual, career politicians, warmongers, and the people that Liz Cheney associates with. It’s about us, we the people right?

Lake simply knocked it out of the park here. Concise, powerful, truthful – I mean, it doesn’t get much better than this. What separates Lake and DeSantis from others, beyond their actual conservative values, is that they are extremely effective communicators. They pinpoint the problems, they provide actual solutions, and they say things so many of us are thinking and either can’t or won’t.

Lake is dead right saying Liz Cheney is washed up and desperate. How pathetic is it to get kicked out in the primaries and then pretend you still represent the will of the voters by actively campaigning against someone handpicked in another primary process? She’s as foolish as she is ignorant and evil.

Lake then correctly states that the new Republican Party – not Cheney’s version of the Republican Party – represents regular Americans of all backgrounds. Democrats and the corporate media continue to pretend that people like Joe Biden and Kamala Harris defend the little guy, but not a single average person has benefited from their corrupt regime. Everything costs more, freedoms are being eroded, and war looms in every direction. We are living through a manufactured crisis for the benefit of the elites.

Hopefully, Arizona wises up and votes GOP again, unlike 202o when they disastrously gave Biden their electoral votes. Lake will be amazing.

Pardon my repetition, but I’m not seeing it, and neither are the satellites, so Climate Cult Central should have a serious credibility problem. You guys can’t predict a damn thing. It must be embarrassing.

But no, that’s not how the left works. It is an opportunity. Just ask Frauline Jacinda (Sieg Heil) Ardern, New Zealand’s PM. She just told the UN we need to control the online narrative to ensure (their truth) gets to the people and not much else.

 

As leaders, we are rightly concerned that even those most light-touch approaches to disinformation could be misinterpreted as being hostile to the values of free speech we value so highly.

But while I cannot tell you today what the answer is to this challenge, I can say with complete certainty that we cannot ignore it. To do so poses an equal threat to the norms we all value.

After all, how do you successfully end a war if people are led to believe the reason for its existence is not only legal but noble? How do you tackle climate change if people do not believe it exists? How do you ensure the human rights of others are upheld, when they are subjected to hateful and dangerous rhetoric and ideology?

 

The American Left promises us that severe weather is getting worse (it’s not) and that only they can stop it (they are lying – about all of it). But that problem is the same for every authoritarian in human history, as is the solution.

Jacinda and the globalists suggest that governments and their corporatist partners tag contradictory information as disinformation that should be silenced to protect free speech. If you’d like a glimpse at how that looks, California has criminalized the truth.

 

The bill, AB2098, introduced by Democratic Assembly Member Evan Low, declares that a physician or surgeon commits professional misconduct if they disseminate “misinformation or disinformation” about the nature and risks of COVID-19, its prevention and treatment and the development, safety and effectiveness of vaccines. …

The bill’s language says that the Federation of State Medical Boards has warned that physicians who spread misinformation or disinformation “risk losing their medical license, and … have a duty to provide their patients with accurate, science-based information.

 

If you dare to practice “medicine” outside the COVID Cult’s approved dogma, you can be excommunicated from the practice of medicine in the state. That means ignoring non-invasive treatment with licensed drugs or therapy in favor of the approved pharmaceutical intervention and treatments that we refer to colloquially as death by hospital.

That’s what Jacinda and the globalists want, and corporatists like Google, Microsoft, Apple, and Facebook are willing partners in this fascism. To that, we could add banks, credit card companies, and a growing list of socialist corporatists looking to be the government’s favored vendor in the New World Order.

We can’t do much about New Zealand, but the First Amendment supersedes all law in America, including that new one in California. But if we fail to elect politicians who will defend it and protect it by punishing those who infringe on it and other enumerated natural rights, the parchment, as Mary Maxwell likes to call it, is barely even that.

Only you can protect your rights, but you need to do it at every turn and in every election, or it’ll be like that empty jar or the Atlantic on Oct 2.

Sunday Spotlight: A Pastor, Gentleman, Politician

Each Sunday, I take a step away from daily politics and focus on someone who has done extraordinary things or who we may need to know a little better. This week’s focus is on a person I have thought highly of for some time.

He is an unlikely choice for Spotlight, but dig deep, and he is a person of quality in a business where that is rare. He is the former Governor of Arkansas, Mike Huckabee.

Mike Huckabee is a Baptist Minister, and though I never saw him preach, I sense his preacher demeanor every time I hear Mike speak. He has a calmness and confidence about him that augments his strong Conservative views. I always feel like Mike is committed to his beliefs and delivers his message in a convincing manner that is genuine.

Huckabee served two terms as Governor and was once named a top ten and top five Governor. He trimmed expenses and taxes and was highly praised for his guidance of his state through Katrina. Mike ran for president twice and finished third behind John McCain and Mitt Romney in 2008. Huckabee has had much to offer as a contributor on FOX News, He is easy to listen to, and his views are solid.

Mike has hosted a talk show on Fox and TBN since 2007. He talks about politics with people in the news and showcases his other passion, music. Mike is an accomplished bass player, and music is just another way that Mike communicates. Though his time in public service may be over, politics still runs through his family tree as his daughter, Sarah Huckabee Sanders, has a comfortable lead and looks to be the next Governor of Arkansas. You can see many of her father’s traits in Sarah; she should be a good choice for Arkansas.

Arkansas will not be the only state to turn to Conservative leadership in November, as two years of negativity under this Progressive experiment has proven to be much for Americans.

Huckabee is still working to promote Conservatism, love of this country, and an understanding of our history. We need to understand the steps we took to arrive at this point and identify the mistakes as well as the accomplishments. Reflection is how we can learn and make tomorrow a better day for all of us.

You will see Mike on the air promoting various products. Still, possibly the most impactful of his efforts is teaming up with President Donald Trump to put an illustrated history of America into the hands of each of our schoolchildren. We will have to work long and hard to overcome the suppression of our history by our progressive and defective education system, and this effort is one step by two great men in that direction.

Mike Huckabee is a religious man, has proven to be a noble man, and is obviously a man who loves this great country and sees the good in Americans. He believes in a Conservative system that has proven to work for everyone, regardless of ethnicity or color. We would do well to learn from Mike Huckabee and seek out more men and women with his values and beliefs.

Chris Pappas Admits Entire Campaign Based on a LIE … “Press” Just Ignores

Hat-tip to NH-NeverTrumpJournal. So Chris Pappas has admitted that his claim that Karoline Leavitt supports a national abortion ban … which is the basis of his entire campaign … is baseless.

Not surprisingly, no coverage from New Hampshire’s disinformation-duo, Adam Sexton and Josh Rogers. Sexton can find the time to cover Hassan’s crazy claim that Bolduc wants to end Social Security. But cover the incumbent Democrat admitting that the political-ads he has been blanketing New Hampshire with are a LIE? No time for that.

Rogers just couldn’t wait to run a hit-piece on Bolduc titled that Bolduc abandoned “false claims.” But don’t hold your breath waiting for anything on Pappas admitting his campaign is based on a LIE.

Because Rogers … like Sexton … like the “journalists” at New Hampshire Bulletin and elsewhere … are NOT journalists. They are Democrat activists who believe that the press’  job is to elect Democrats.

Can We Afford to Repair Florida

Hurricane Ian is gone, but it has left us with years of rebuilding. There are areas of Florida that will not be rebuilt. They are so devastated that the only option will be to bulldoze and start from scratch. People have lost every physical possession and are finding they have no insurance and nowhere to turn.

There was no discrimination on the part of Ian. Rich, poor, white, black, or brown were all victims. There is no one to blame for their situation. They were living their lives one day, and by the will of God and a stroke of bad luck, they were in the path of nature’s evil.

Cities like Sarasota still have 70% of the residents without power, and downed trees hamper the recovery process. The flooding continues from the rain and water from the Gulf. Now the residents are bracing for water from the rivers to the east that is overflowing. Four days after Ian passed this area, the devastation is not yet done. The meter keeps running.

Power is being restored, and water is flowing for many, but some areas of southwestern Florida have seen massive damage to the infrastructure that will require months or years to correct. Bridges that once were the only access to island communities are washed away, and barges will be the mode of connection for the foreseeable future. The damages will be investigated and prioritized, and the meter will keep running on the total cost of the devastation. Where will the funds come from to put Florida and South Carolina back together again? In a true American manner, we will start the presses and print what is needed.

The government is spending money at record rates. The National Debt no longer appears to be a concern. We do not plan for tragedies like Ian as we continue spending as the well will never run dry. The problem is the well ran dry years ago, and now we are just borrowing from our future. Every month, we see billions of dollars of aid going to Ukraine. These funds are not debated as stand-alone bills but are included as footnotes in bills like the continuing resolution signed this past week. A continuing resolution is a means of keeping the government running without a shutdown. These CRs are now a means to bury spending without debate or notice. There is no accountability for these funds.

The President is prepared to spend up to a trillion dollars buying votes with Student Loan Forgiveness while we have people who have lost everything looking for just a little help. Helping these people is the right thing but is not the way to assure political power for Biden and his Party. Politicians like Biden are not concerned with being correct. Their only concern is remaining in power. That thinking has worked at keeping Joe Biden, a once mediocre Senator and now a senile President, entrenched in D.C. for over fifty years.

There is a movement worldwide as countries elect Conservative leaders. The people are speaking as they will be here in less than forty days. We will start holding these people accountable, and wasting money to buy votes will no longer be accepted. Somebody has to step up now and say no more for Ukraine and pet projects until Florida is intact and money is in the bank to handle future disasters that put our brothers and sisters in pain.

Biden Admin: So, About that Student Loan Forgiveness Thing …

The Biden administration has altered the student loan forgiveness plan. Pray, they don’t alter it any further.

 

The Biden administration quietly issued an update to its student loan forgiveness plan on Thursday, drastically scaling back eligibility on the same day that six Republican-led states filed a lawsuit against President Joe Biden, claiming his student loan forgiveness plan is illegal.

 

There is some confusion about what the law might allow if anything. The Republicans say the deal is illegal. Biden Dems say that a provision of a 2003 law permits them to use the pandemic as a vehicle for student loan forgiveness.

 

White House officials have argued that Biden’s student loan forgiveness plan is legal under the Higher Education Relief Opportunities for Students Act of 2003 (HEROES Act), which grants the Department of Education the authority to cancel so much debt for so many people because of the COVID-19 pandemic.

 

New Hampshire is not one of the states challenging the move.

 

The states of Arkansas, Iowa, Kansas, Missouri, Nebraska, and South Carolina, in a lawsuit filed in federal court in Missouri, claimed that the move is illegal.

 

If you were not aware, the governor of Kansas is a Democrat who also opposed private business vaccine mandates and Biden’s OSHA mask mandate. That makes this a bipartisan rejection of the Biden mid-term vote-buying bailout plan, which they say is illegal.

 

The Biden administration itself concluded in a legal opinion (pdf) that any cancellation must be “structured to put loan recipients back into the financial position they would be in were it not for the national emergency” and limited only to the harm that has a relation to the borrower’s federal loans, “no matter how much [total] financial harm a borrower may have suffered because of a national emergency,” the suit states.

“The Biden Administration’s Mass Debt Cancellation does not even attempt to meet these requirements.

 

I think the Bidenistas know it’s illegal but don’t care. It is a calculated win-win for Dems, in their eyes. If it flies, they can buy “friends” and votes through loan forgiveness (and consolidation) at taxpayer expense. If it falls out of the sky, they can blame Republicans for burdening millions with excessive student loan debt (even if it is illegal).

And isn’t that the pot calling the kettle black? The Left has spent so much money that people not yet born will be paying taxes on the debt created y elected officials for whom they did not vote.
